Preamble: Purpose of this privacy policy

As part of its activities, Cinod, as well as its associated services Monplandescene and BookingTech, processes personal data in compliance with the regulations in force, in particular the French Data Protection Act of January 6, 1978, as amended, and the General Data Protection Regulation (RGPD) of April 27, 2016, applicable since May 25, 2018.

Cinod undertakes to respect your personal data and to treat it with the utmost care.

The purpose of this privacy policy is to inform you about how Cinod uses and protects the information you provide to us.

By connecting to our sites and using the services of Cinod and its associated services, you accept the present confidentiality policy. The information we request is strictly necessary for the use of our services.

Article 1: Definitions

* Cookies:** Small files deposited on the User’s hard disk when visiting certain websites, enabling information to be stored for later connection.

* Site:** All sites, Internet pages and online services offered by Cinod, accessible from the following URL addresses: (https://www.cinod.fr), (https://www.monplandescene.com) and (https://www.bookingtech.fr).
* Processing of personal data:** Any operation or set of operations concerning such data, whatever the process used (collection, recording, organization, storage, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, reconciliation or interconnection, blocking, erasure or destruction, etc.).

Article 2: Data controller

The company responsible for processing the personal data referred to herein is SARL Cinod, registered with the Registre du Commerce et des Sociétés under number RCS 484 217 195 Nanterre.

Article 3: Collected data

With your prior consent, when you use our media, we may collect and process some or all of the following data:

**BookingTech :**

Article 4: Purposes of collecting personal data

The purpose of a processing operation is defined as the main objective of a computerized application of personal data.

In the case of Cinod, these purposes are as follows:

* Customer relationship management
Sending personalized e-mailings
Providing the information or services you have requested (e.g. newsletter, commercial offers, etc.).)
* Collection of information enabling us to improve our Site, our products and services (in particular by means of cookies)
* Possibility of contacting you about various events relating to Cinod, including product updates and customer support.
* Facilitating the employee/employer relationship by sharing information (skills and availability).

Article 5: Data recipients

* **Transmission of data to third parties

Cinod is the sole recipient of your personal data. This data, whether in individual or aggregated form, is never transmitted to a third party, notwithstanding the subcontractors Cinod uses. Neither Cinod, nor any of its subcontractors, market the personal data of visitors and users of its Site.

Cinod requires its service providers to use your personal data only to manage the services we ask them to provide.

Cinod also asks its service providers to always act in compliance with applicable laws regarding the protection of personal data and to pay particular attention to the confidentiality of such data. In pursuit of this objective, Cinod verifies the compliance of its subcontractors beforehand.

* List of subcontractors

At present, the data recipients are :

* Nuxit: Outsourcing of servers, located in France (RGPD compliance).
* Smartsupp: Chat service (RGPD compliant).
* YourInvoices: Operations related to bookkeeping (RGPD compliance).
* SGAutorépondeur: e-mailing service (RGPD compliant).

* Data retention period

Regarding the retention period, Cinod keeps your data for the duration of the contractual relationship, but also :

* 36 months (3 years) from the last contact for prospects and from the end of the commercial relationship for customers. Cinod deletes the personal data of people who have been inactive for 3 years from the database and places them in an exclusion database.

Every 13 months thereafter, Cinod asks for the consent of visitors to the Site to process cookies.

Article 6: Cookies

You can deactivate or activate cookies at any time. The purpose of these cookies is to record information relating to site navigation (date and time of consultation, page consulted, date and time of click, place of click, etc.). This information enables Cinod to personalize the site, facilitate access to sections, etc.

* **Cookie purpose**

Article 7: Transfer of personal data

Cinod reserves the right to access, retain and share the User’s personal data in response to a legal request (search warrant, court order or other) if required by law.

Cinod undertakes to comply with applicable regulations relating to data transfers. If data is transferred to foreign countries, this will be done as follows:

* Cinod transfers its Users’ personal data to countries recognized as offering an equivalent level of protection. The list of these countries is available on the site of the CNIL: (https://www.cnil.fr/fr/la-protection-des-donnees-dans-le-monde).
* Cinod transfers the personal data of its Users outside the countries recognized by the CNIL as having a sufficient level of protection: Cinod has obtained authorization from the CNIL to proceed with this transfer.
* Cinod transfers the personal data of its Users to recipients who can present sufficient guarantees of RGPD compliance.
* Cinod only transfers the personal data of its Users with regard to what is strictly necessary for the purpose of the processing concerned.

At present, the only treatments concerned by this provision are :

* The purchase of services offered by Cinod to the user who has decided to pay via PayPal. Only the following data is transferred: CUSTOMER ID, email address, purchase amount, product designation.
* The management of ethical and personalized commercial relations through information sent to Facebook via the “Personalized Audience” feature offered by Facebook. The email address is the only data transferred to enable Facebook to identify its users and build up an audience.

Article 8: Hosting of personal data

Your personal data is stored either in our databases or in those of our service providers.

The User has the possibility of deleting his account at any time, by simple request to Cinod or by the menu of deletion of account present in the parameters of the account, if necessary.

Cinod reserves the right to terminate or restrict access to the services and your account without prior notice in the event of a breach of any provision of these terms and conditions or any other document incorporated herein by reference.

Article 11: Safety measures

Cinod takes the necessary measures to protect your information, in particular by attempting to prevent unauthorized access. However, we cannot guarantee the absolute security of your data transmitted to the website, given the immensity of the Internet and the constant development of technologies.

If you have chosen a password to access certain parts of the website, you are responsible for maintaining the confidentiality of that password. We advise you not to share your password with anyone and to change it periodically.

Cinod’s security measures include the following:

* Secure browsing with SSL certificate.
* Firewall.
* Restricted access to SSH console.
* Access to certain password-restricted areas.
* Consent is archived by recording the IP address, the date of registration, the URL used for registration and the reference of the opt-in form.
* Data backup on a remote server.
* Access rights management.
* Strong password policy.

Article 13: Limitation of liability

In the event that you suffer damage as a result of the exploitation of a security vulnerability by a third party, Cinod undertakes to provide you with all necessary assistance to enable you to assert your rights. Furthermore, if, by exception, the damage suffered resulted in part from a fault or gross negligence on the part of Cinod, you may obtain compensation within the limit of the liability ceiling specified in our general conditions of sale and use.

Where users are permitted to post content on this site, Cinod reserves the right to remove, without prior notice, any content posted that contravenes the legislation applicable in France, in particular the provisions relating to data protection.

Cinod also reserves the right to hold the user civilly and/or criminally liable, particularly in the event of messages of a racist, insulting, defamatory or pornographic nature, whatever the medium used.

Article 14: Information collected from children

The services are not intended for children and it is forbidden to use our services if you are under the age of 15, in accordance with French legislation.

Article 15: Dispute resolution/litigation

Any dispute to which the privacy policy may give rise, in particular concerning its validity, interpretation and execution, their consequences and their aftermath, will be submitted to the competent courts of Toulon.
